1. Provision of Services

This online service for the provision of foreign currency (“this Service”) is provided for and on behalf of Currency Exchange Corporation Limited trading as Sainsbury’s Travel money, the Website Owner(s) by First Rate Exchange Services Limited, a company registered in England and Wales under company registration number 04287490 (Money Service Business licence number MLR-64068), whose registered office is at Botanica Ditton Park, Riding Ct Rd, Datchet, SL3 9LL England (“First Rate”).

You have accessed this Service via a direct link from a website (“the Website”) operated by the Currency Exchange Corporation Limited trading as Sainsbury’s Travel money.

The Website Owner may use your personal information to communicate with this Service or for marketing or research purposes. You should acquaint yourself with any privacy policy which appears on and/or may be accessed via the Website. First Rate will not be responsible for any contact made with you or any material supplied to you by the Currency Exchange Corporation Limited trading as Sainsbury's Travel money or any third party.

If you do not wish to receive communications from the Currency Exchange Corporation Limited trading as Sainsbury’s Travel money, you should follow the relevant instructions contained in the Currency Exchange Corporation Limited's Privacy Policy or notify the Currency Exchange Corporation Limited of that wish.

When placing your order, you will have the opportunity to indicate whether you would like to receive marketing messages from the Currency Exchange Corporation Limited trading as Sainsbury’s Travel money You will need to actively tick your preference to receive these messages.

These Terms and Conditions apply to this Service.

This Service is available to individuals aged 18 years or over, resident within the UK. Orders can only be placed by registered cardholders of the payment cards used for paying for the orders. UK issued credit or debit card payments only.

Please note that these Terms and Conditions are available only in English and you agree that English shall be the only language used by First Rate to communicate with you during and for the provision of this Service.

1. Agreement

By utilising this Service you confirm that you:

  1. are at least eighteen (18) years of age,
  2. are the registered holder of the payment card,
  3. acknowledge that you have read and understood these Terms and Conditions,
  4. agree to be bound by them and to comply with all applicable laws and regulations. You also agree to use this Service to order foreign currency for holiday or business travel purposes only.

3. Important notice

The value of foreign currency can go up and down due to changes in exchange rates. These changes are outside of First Rate’s control. In extreme situations, currency market conditions may prevent First Rate from supplying currency to you. In such circumstances First Rate reserve the right to cancel your order. If this happens, First Rate will tell you.

If your order is cancelled due to currency market conditions, First Rate will refund the Pound Sterling amount that you have paid back to your card. First Rate will refund any cash advance charges made by your card issuer on request. Please see section Order Changes and Cancellation.

4. Orders

You agree to provide the information required to process your order. First Rate may apply a minimum and maximum order value limit for foreign currency and will tell you if this applies on the online ordering screen. First Rate only stock certain denominations of foreign banknotes. This means First Rate may need to round your order up or down on the online ordering screen to the nearest amount for which banknotes are available.

To place an order, follow the instructions on the online ordering screen. First Rate may need to request further information from you at any time to enable First Rate to complete your order and/or to comply with regulatory requirements. It is important that you provide correct contact details so First Rate can reach you should further information be required to process your order. If First Rate is unable to contact you, this may result in your order not being processed and a full refund will be applied to your card. First Rate will refund any cash advance charges made by your card issuer on request.

First Rate can refuse to process your order for any reason; First Rate will tell you if this is the case and a full refund will be applied to your card. First Rate will refund any cash advance charges made by your card issuer on request.

A delivery charge may be applied to your order and, if applicable, will be detailed on the online ordering screen. First Rate may amend this charge from time to time.

By placing the order, you confirm that the details contained in the order are correct in all respects. Once you have placed your order you will see a confirmation screen setting out the details of your order. This confirms First Rate has received your order. Your order is completed when your credit or debit card payment has been accepted by First Rate. Please print a copy of the confirmation screen for your records.

First Rate only stocks certain denominations of the foreign currencies listed on the online ordering screen and you agree that your order will be processed with the denominations available at the time of processing, failing which, you agree that your order will automatically be rounded to meet the denominations available.

Accordingly, First Rate reserves the right to vary order values shown on the online ordering screen from time to time, at its discretion, without notice and without liability to you. First Rate will normally try to fulfil your order with a mixture of different denomination notes. However, this is dependent on stock availability and First Rate reserve the right to fulfil your order using denominations of its choice.

5. Foreign Currencies and Rates

This Service is only available for the currencies listed from time to time on the online ordering screen. The exchange rates quoted by First Rate may be updated at any time. Should extreme fluctuation in the exchange rate occur between you placing your order and the dispatch of your order, First Rate shall have the right to cancel your order as per Section 3 (Important Notice). In extreme situations, currency market conditions may prevent First Rate from supplying currency to you.

Please note that foreign currency availability may be subject to monetary limits, currency exchange restrictions and anti-money laundering regulations.

It is your sole responsibility to meet the currency import and export measures and requirements of the UK and any country you may be visiting. For more information, please refer to www.gov.uk and search for ‘Take cash in and out of the UK’.

First Rate or Currency Exchange Corporation Limited trading as Sainsbury’s Travel money will not be responsible for any losses, damages or claims you may suffer as a result of your failure to comply with these measures or requirements.

6. Anti-money Laundering/Fraud Prevention/Counter Terrorism Financing

First Rate Exchange Services Limited is regulated by His Majesty's Revenue and Customs ("HMRC") as a registered Money Service Business ("MSB"). First Rate reserves the right at all times, to decline any orders, at any stage, which it believes, contravene its obligations under the appropriate Legislation / Regulation. First Rate takes its obligations in respect of money laundering and terrorist financing very seriously and First Rate is obliged to report to the appropriate authorities any suspicions and/or high value transactions without further reference.

We apply customer due diligence in line with the Money Laundering Regulations 2017 on a risk based basis, including for occasional transactions that meet regulatory thresholds. Verification is conducted electronically (eKYC) using reliable data sources and does not normally require documents, although additional information may be requested where necessary. Transactions may be delayed or declined if verification cannot be completed.

7. Order Delivery

Your order will be delivered to the address selected by you on the online ordering screen or the billing address of the debit / credit card used to pay for the order. For Home Delivery orders the billing address is the delivery address, if not the order may be refused. Any applicable delivery fee(s) will be displayed during the ordering process.

To provide the service, First Rate may utilise the services of the Royal Mail Special Delivery Services to deliver your order. This service is available only to addresses in the United Kingdom. If the delivery address is that of a multiple occupancy building i.e. office block, be aware that Royal Mail may deliver to other delivery point or the reception.

Royal Mail require a signature at the point of delivery, from the recipient or someone at the address. It is your responsibility to be present to sign (and print your name) to accept delivery for your order. You accept responsibility for your order when your order is signed for at the delivery address.

Prior to signing for the delivery, you must make sure that the package handed over to you is secure and has not been tampered with or damaged. If this is the case, you must refuse to accept any package, as if you sign for a package which has been damaged or tampered with, you may incur in financial loss, for which First Rate is not responsible.

First Rate aim to deliver your order within the timeframe and date specified in the journey and FAQs. First Rate do not guarantee next day delivery or that the order will be delivered at the requested delivery date. First Rate will not be held liable for any issues, expenses or costs as a result of a delivery arriving later than expected.

The delivery timings for orders are as stated in the “FAQs” page which is available on this Service. First Rate reserves the right to amend the delivery timings from time to time and, in the event of such an alteration, will endeavour to notify you as soon as is reasonably possible by telephone or email.

Royal Mail are responsible for the delivery of the order. You acknowledge that the delivery responsibility has been assigned and transferred from First Rate to Royal Mail at the point of handover between First Rate and Royal Mail.

7.1 Tracking of Order

For home delivery orders you can track your order any time by using the tracking details provided to you by Royal Mail (email/text message is sent to the mobile/email address you provided as part of the order process) after your order has been dispatched and then visiting https://www.royalmail.com/track-your-item.

First Rate will not be responsible for any redirected items. Please contact Royal Mail if you have a redirection order in place.

7.2 Failed or missed delivery

If, for any reason, you do not receive your order please contact Customer Services as detailed in the “Contact us” page accessible through the online ordering screen. Customer Services will commence a thorough investigation to ascertain the location of the order and reason for non-delivery.

Failed or missing deliveries will not be immediately refunded. They will be dealt with under the Royal Mail’s claim procedure. A refund will only be payable following a Royal Mail investigation and their confirmation of a failed delivery. Please note that a Royal Mail investigation may up to 30 business days to investigate and respond.

A replacement order, alternative delivery or refund may be arranged where appropriate at First Rate’s discretion. First Rate may charge you for the replacement order whilst it investigates the reason for non-delivery or may charge you for the replacement order at the completion of the investigation. First Rate cannot accept any responsibility or liability for safe delivery beyond the handover of the relevant order to your chosen delivery address or any liability for fraudulent acts committed by any third party, once order has been handed to Royal Mail for delivery.

7.3 Insurance claim for failed or missed delivery

It is your responsibility to be present to sign (and print your name) to accept delivery for your order. Royal Mail use geo location/ plus signature (remember Royal Mail only require a signature at the point of delivery, from the recipient or someone at their address) and/or picture as proof of the delivery. Should they reject the claim of non-delivery, Royal Mail is confirming to both you and First Rate that the package has been delivered as addressed. First Rate will contact you to decide how to best assist you with the failed or missed delivery order.

7.4 Royal Mail T&Cs and Restrictions

8. Payment

The amount you have to pay for your order shall be paid in Sterling and calculated in accordance with the total amount of the foreign currency ordered by you and converted into Sterling in accordance with the relevant exchange rate(s) as specified in Section 5 (Foreign Currencies and Rates).

You can pay for your order using most credit and debit cards issued in the United Kingdom (MasterCard, Visa) providing the card is registered in your name and there are sufficient funds available to cover your order and fees. Payment will be taken on the day of your order or shortly after.

Your credit card issuer may charge you interest and/or fees on paying by credit as they consider it a ‘cash advance’. This is not a service charge made by First Rate or Currency Exchange Corporation Limited trading as Sainsbury’s Travel money and you acknowledge that First Rate and Currency Exchange Corporation Limited trading as Sainsbury’s Travel money has no control over and are not responsible for such charges. If you wish to pay by MasterCard Corporate or Visa Corporate credit card a handling fee will be displayed in the online ordering screen. This will be shown within your order summary

8. Payment

In relation to foreign currency

Due to the nature of foreign currency as a money product, cancellation can only be undertaken prior to dispatch of your order by First Rate. First Rate, at its discretion, reserves the right to apply a cancellation charge up to the value of £20 per order.

First Rate reserves the right to cancel any order prior to the order delivery date due to extreme fluctuation in financial markets outside First Rate's control as specified in Section 3 (Important Notice). If this occurs, First Rate will endeavour to notify you as soon as is reasonably possible by telephone or email. In any event, please note that First Rate does not refund cash advance charges made by your payment card issuer. You should refer to your payment card issuer to seek the refund of the cash advance fee.

Should you request cancellation of the order once it is out for delivery according to Section 7 (Order delivery), in order for you to be refunded, you will firstly, need to return the order to First Rate via Royal Mail Special Delivery. Please note First Rate is bound by the time taken for Royal Mail to return the package to the First Rate location and not liable for lost/missing packages should it occur when being returned to First Rate.

When First Rate receive the returned order and confirm the correct currency amount within the package, you will be refunded within 2 to 3 working days from the date it is received, less any fees or charges.

10. Personal Information And Security

For online security First Rate utilises secure server software. Details of how First Rate may use your personal information are set out in the First Rate Online Privacy Policy and First Rate Security Policy, links to both of which appear on the online ordering screen, under the Help and Support section.

For payment security, First Rate will only accept card payments that have passed 3DSecure. 3DSecure is an authenticated payment system that provides online security for all parties (cardholders, merchants and card issuing banks) involved in an online transaction against unauthorised use. Cardholders are required to set up a password for their card online which is validated by the card issuer each time they make an online payment otherwise known as ‘Verified by Visa’ or ‘MasterCard Secure Code’. 3DSecure provides an additional layer of protection against fraud using online payment methods.

11. Limitation on First Rate's Liability

First Rate shall make every effort to process orders placed via this service without any delay. However, delays can sometimes occur due to technical problems or matters out of First Rate's control.

First Rate uses reasonable care and skill in providing this service. However, First Rate does not guarantee that access to this service shall be continuous, uninterrupted, secure, error free or free from viruses.

First Rate shall not be liable to you for the following:

  1. If First Rate is unable to perform any of its obligations to you due to the failure of any technical systems or for any other reason beyond First Rate's reasonable control, including amongst other things: war, terrorism, government action, natural disaster and industrial dispute;
  2. For any damage to your computer equipment as a result of using the Website or this service;
  3. For any claims or damages (including, without limitation, indirect or consequential loss, loss of profit and whether in contract or in tort) suffered by you or incurred from your use or delay or inability to use the Website or this service however caused.

First Rate's maximum liability to you in respect of each use of this Service shall be to refund the purchase price of your order.

These Terms and Conditions, the disclaimers and limitations of liability shall not apply to any damages arising from death or personal injury caused by the negligence of First Rate or any of its employees or agents or for fraud or fraudulent misrepresentation.

If any provision of these Terms and Conditions including these disclaimers and limitations shall be unlawful or unenforceable then such provision shall fall away and shall not affect the validity and enforceability of the remaining terms or any of your statutory rights which cannot be excluded by these Terms and Conditions.

12. Disclaimer

None of the information provided in connection with this service constitutes, nor should it be construed as financial advice. First Rate provides information using all reasonable endeavours to achieve accuracy but this cannot be guaranteed. First Rate therefore does not warrant the accuracy of any information provided and excludes any implied warranty, in particular relating to exchange rates, market prices and data. Neither First Rate, nor any entity from which it receives information, nor the Website Owner shall be liable for any investment or other decisions made on the basis of the information provided.

13. Third Party Rights

Other than First Rate and the Website Owner, nothing in these Terms and Conditions will confer any benefit on any third party or any right to enforce these Terms and Conditions.

14. Governing Law

These Terms and Conditions are governed by and construed in accordance with English Law.

15. Fees and Charges

Fees and charges which apply to your order will be displayed on the ordering screen during the online ordering process (except for any charges levied by your card issuer). From time to time, First Rate may amend or add charges at its discretion but the revised charges will be displayed on the online ordering screen before you place an order.

16. Variations of these Terms and Conditions

These Terms and Conditions are subject to change from time to time without notice and First Rate reserves the right to make these changes at any time without notice. You are required to read these Terms and Conditions before placing an order. Your continued use of this service after these changes constitutes your acceptance of these Terms and Conditions as modified.
